TRUMP SIGNS ORDER TO RESCHEDULE
Much of the cannabis world cheered as President Donald Trump signed an executive order calling on U.S. Attorney General Pam Bondi to expedite the process of rescheduling marijuana from a schedule I controlled substance to less restrictive schedule III.
Politico
Trump’s order cites a review by the U.S. Department of Health and Human Services, ordered by President Joe Biden, which endorsed rescheduling. The measure was before the DEA (part of the Justice Department) when Trump returned to office in January.
While Trump teased rescheduling in August, his administration has stepped up cannabis enforcement in some respects. Last month Trump signed a federal ban on intoxicating hemp-derived products as part of the deal to end the federal shutdown.
- The order also aims to make CBD more accessible to Medicaid and Medicare patients.
Rescheduling raises many new questions for the industry, beginning with: “When will it happen?” But many insiders are confident it will end the impact of industry-hated tax rule 280E which explicitly only applies to schedule I and II substances.

- The state markets will remain federally illegal. Rescheduling “only exacerbates a bad situation,” three pro-legalization policy experts argue in the LA Times. “Picture Schedule III as a rudderless, aging ship taking on water. Adding cannabis is like piling a whole bunch of new cargo onto this sinking vessel.”
- It may inspire Congress to pass banking reform. With many prominent conservatives opposed to rescheduling, Trump dismissed GOP dissenters.
